Terms and Conditions

By accessing our site, placing an order, requesting a site survey, or submitting engraving/custom content, you agree to these Terms.


1) Eligibility, Accounts & Electronic Communications

  • You must be 18+ (or the age of majority where you live).
     
  • Keep your account info accurate and secure; you’re responsible for activity on it.
     
  • You consent to receive transactional communications electronically (order updates, proofs, policy notices).
     

2) Orders, Pricing, Taxes & Financial Transactions

  • Your order is an offer; we may accept or decline at our discretion.
     
  • We may withdraw or cancel services or orders (e.g., suspected fraud, errors, supply limits); if we cancel after charging you, we’ll refund the affected amount.
     
  • Prices may change without notice; taxes/shipping may apply.
     
  • Payments are processed by third parties (e.g., Stripe/Square); we don’t store full card numbers. You authorize us to charge your chosen method.
     

3) Service Availability, Site Changes & Downtime

  • We may modify, suspend, or discontinue any part of the site or services at any time.
     
  • Availability isn’t guaranteed; the site may be unavailable due to maintenance, outages, or factors beyond our control.
     
  • Content may contain typographical, pricing, or availability errors; we may correct them at any time.
     

4) Shipping, Delivery & Risk of Loss

  • Title and risk transfer when the carrier receives your order (or upon local delivery to you).
     
  • Delivery dates are estimates. Inspect shipments and report damage within 5 business days.
     

5) Site Surveys ($50 Credit)

  • Options: In-person (limited service area) or virtual (photos/video).
     
  • Fee & credit: The $50 fee converts to a single-use store credit valid for 60 days; not cash-redeemable or transferable.
     
  • Scope: Advisory fit verification and recommendations only. A site survey is not an engineering, architectural, or safety certification and does not replace your obligation to confirm structural integrity, code/venue compliance, or safe use.
     
  • Your responsibility: Provide accurate information and follow all HOA/venue rules and laws. Decisions to install or use products are yours.
     

6) Engraving & Custom Orders

  • You warrant you own/have rights to all text, logos, and artwork you submit and that it’s lawful and non-infringing.
     
  • We produce from your approved proof. Screen previews can vary from final materials/finishes.
     
  • Lead times start after proof approval and payment.
     
  • Custom and engraved items are generally non-returnable except for manufacturing defects (see Warranty/Returns).
     

7) Acceptable Use & User Behavior (Community Rules)

You agree not to: violate laws or third-party rights; engage in harassment, bullying, hate speech, threats, or doxxing; post spam/scams/unauthorized promotions; scrape/crawl/reverse-engineer the site; introduce malware; interfere with security; impersonate others or misrepresent affiliation.
We may remove content and disable or terminate accounts that violate these rules or these Terms.


8) Product Use, Safety & Installation

  • Use at your own risk. You are solely responsible for installation and use.
     
  • Not a safety device. Products are not guardrails, fall-protection, ladders, steps, seats, or supports for people. Do not sit, stand, or step on the product.
     
  • Structural responsibility. Confirm that your rail/fence and mounting surface are structurally sound, compatible, and code/venue compliant.
     
  • Follow instructions. Install and use only as directed. Distribute weight evenly and keep within everyday-item use.
     
  • Environment. Remove and store products during storms or high winds; avoid open flames, excessive heat, or corrosive chemicals.
     
  • Inspection. Check fasteners and contact points before each use; discontinue use if any damage, looseness, or instability is observed.
     
  • Supervision. Keep out of reach of children; supervise use around minors and pets.
     

8A) Assumption of Risk & Release

By purchasing, installing, or using RailMi products, you acknowledge and voluntarily assume all risks associated with installation, use, misuse, modification, overloading, use in prohibited/unsafe locations, and failure to follow instructions or local rules.
To the maximum extent permitted by law, you release and hold harmless RailMi from claims, losses, liabilities, damages, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to such risks, including property damage, spills, drops, and personal injury, except to the extent caused directly by RailMi’s willful misconduct or legally non-waivable obligations.

8B) No Professional Advice

Any guidance on our site or provided by support (including site surveys) is general information, not professional engineering, architectural, or legal advice. You are responsible for obtaining appropriate professional advice where needed.

8C) Surface & Structure Disclaimer

By installing or using RailMi products, you acknowledge that contact points, clamping forces, fasteners, or movement of items on the product may cause marks, marring, indentations, abrasion, finish wear, corrosion, discoloration, cracking, water intrusion, loosening, or other damage to railings, fences, posts, decks, balconies, glass, masonry, coatings/paints, and adjacent structures/fixtures. You are solely responsible for confirming material compatibility (e.g., powder-coated aluminum, painted steel, stainless, wood, composite, vinyl, glass, masonry) and for testing in an inconspicuous area. To the maximum extent permitted by law, RailMi is not responsible for any such surface or structural damage, whether arising from installation, contact, environmental exposure, or use.


9) Intellectual Property; Copyright & License

  • The site, designs, photos, and trademarks are our IP or our licensors’.
     
  • You may not copy, adapt, distribute, or use our content commercially without written permission.
     
  • Limited press/retailer use may be granted via our brand assets with attribution as specified in our guidelines.
     
  • DMCA/Notice: If you believe content infringes your rights, email copyright@railmi.com (or info@railmi.com) with details; we may remove content and notify the submitter.
     

10) User Content & Testimonials

When you submit reviews, photos, or tag us for permission, you grant RailMi a non-exclusive, royalty-free license to use that content for marketing (you can revoke future use by emailing us). You remain responsible for your content.


11) Warranty; Returns & Exchanges

We provide a 1-year limited warranty against defects in materials and workmanship when used as directed; remedies are repair, replacement, or refund of the item price. Exclusions include, without limitation: normal wear, cosmetic changes, misuse, improper installation, incompatible rails/surfaces, overloading, weather or chemical exposure, accidents, and modifications.
Returns and exchanges are governed by our Return Policy, incorporated by reference.


12) Disclaimers

EXCEPT AS EXPRESSLY STATED IN THE LIMITED WARRANTY, PRODUCTS AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT that installation or use will be error-free, uninterrupted, or suitable for your particular rail, venue, or application.


13) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RAILMI IS NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR LOST PROFITS/REVENUE. WITHOUT LIMITATION, RAILMI SHALL HAVE NO LIABILITY FOR ANY DAMAGE TO RAILINGS, STRUCTURES, SURFACES, COATINGS/FINISHES, OR ADJACENT PROPERTY ARISING FROM INSTALLATION, USE, MISUSE, OVERLOADING, MATERIAL INCOMPATIBILITY, OR FAILURE TO FOLLOW INSTRUCTIONS OR LOCAL RULES.
OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT OR SERVICE AT ISSUE.


14) Indemnification

You agree to defend, indemnify, and hold RailMi harmless from claims and expenses (including reasonable attorneys’ fees) arising from your misuse of the site/products, your installation or use contrary to instructions or law, or your submitted content.


15) Promotions, Gift Cards & Credits

Promotions have stated terms and may change or end without notice. Site-survey credits, coupons, and gift cards: single use, non-transferable, not cash-redeemable, and may expire as noted.


16) Termination

We may suspend or terminate access or accounts at any time for any reason, including policy violations or security risks. Certain sections (e.g., IP, warranty/disclaimers, limitations, indemnification, disputes) survive termination.


17) Governing Law & Disputes

These Terms are governed by Florida law (conflict rules excluded). Courts in Pinellas County, Florida have exclusive jurisdiction, unless otherwise required by law. (If you prefer arbitration, we can add it.)


18) Changes to Terms

We may update these Terms; the “Effective date” will change. Continued use after changes constitutes acceptance.

Return and Refund Policy

1) Terms of Return (How long?)

  • 30 days from delivery for eligible items.
     
  • Wholesale/Trade orders: 14 days (see §10).
     

2) State of Return (Condition)

  • Items must be unused, undamaged, and in original packaging with all parts/accessories.
     
  • Opened but uninstalled items may be accepted with a 10% restocking fee (covers inspection/repacking).
     
  • Event Packs / multi-packs: must be returned complete (no partial pack returns).
     

3) What’s Not Returnable

  • Custom or engraved items (unless defective or we made an error).
     
  • Final-sale/clearance items (as marked).
     
  • Used/damaged items not caused by carrier damage or a manufacturing defect.
     
  • Site Survey fees (credited toward purchase; see §8).
     

4) Reason for Return (Examples we accept)

  • Ordered the wrong finish/size (unused item).
     
  • Changed mind (unused item).
     
  • Received the wrong item.
     
  • Arrived damaged (see §6).
     
  • Manufacturing defect within warranty (see §7).
     

5) How to Start a Return (Process)

  1. Email returns@railmi.com (or info@railmi.com) with your order #, reason, and photos (if applicable).
     
  2. We’ll issue an RMA with return instructions and the correct return address.
     
  3. Pack securely in original packaging. Use a trackable service and share the tracking number.
     
    • Return shipping is customer’s responsibility unless we shipped the wrong item or it arrived damaged/defective.
       

6) Shipping Damage (on arrival)

  • Inspect on delivery and contact us within 5 business days with photos of the box and item.
     
  • We’ll arrange a replacement or refund and handle the carrier claim.
     

7) Warranty & Defects

  • RailMi products carry a 1-year limited warranty against defects in materials/workmanship when used as directed.
     
  • For suspected defects, email support@railmi.com with photos/video and your order #.
     
  • Remedy is repair, replacement, or refund of the affected item (our choice).
     

8) $50 Site Survey (Credit)

  • The fee becomes a store credit valid for 60 days toward one order; not cash-redeemable or transferable.
     
  • Cancel/reschedule: Please give 24 hours’ notice. If we cancel, we’ll extend or refund the credit.
     

9) Refunds (Timing & Method)

  • Once your return is received and inspected, we’ll notify you and issue a refund to your original payment method within 5–10 business days (bank times may vary).
     
  • Shipping costs are non-refundable unless due to our error or a damaged/defective item.
     
  • If a restocking fee applies, it will be deducted from the refund.
     

10) Wholesale / Trade Orders

  • Return window: 14 days from delivery; items must be unopened/unused in original cartons.
     
  • Restocking: 15–20% depending on quantity and inspection.
     
  • Custom-branded/bulk engraved items are final sale (defect exceptions apply).
     

11) Exchanges

  • Fastest path: purchase the new item and return the original per this policy.
     
  • Or request an exchange in your RMA email—we’ll confirm availability and steps.
     

12) International Returns (if applicable)

  • Duties/taxes paid to customs are non-refundable by RailMi.
     
  • Return shipping/customs paperwork are the customer’s responsibility.
